Tuna Canners Fail to Dismiss Class Action Price Fixing Suits, Judge Imposes some Minor Limitations

The US 'big three' tuna canners as well as Dongwon Industries, Thai Union Group and Del Monte Foods won some procedural points to limit the scope of class-action lawsuits against them but a judge largely upheld the suits, court records show.
In June, Bumble Bee Foods, Starkist, owned by Dongwon and Thai Union-owned Tri-Union Seafoods, which trades as Chicken of the Sea, filed three motions to dismiss asking judge Janis Sammartino to dismiss the plethora of civil lawsuits from retailers, wholesalers, catering companies and members of the public alleging a price-fixing conspiracy took place in packaged seafood products.
In a written opinion published Sept. 26, the judge largely sided with plaintiffs' attorneys...
