FDA Expands Rule on ‘Refusal of Inspection’ Gives Foreign Plants 24 Hours to Answer Query

The FDA has put out a draft constituent guidance document for public comment on how the agency will determine ‘Refusal of Inspection.’
It gives foreign plants 24 hours to respond to any request for an inspection, or have their products denied entry to the US.
The Food Safety and Modernization Act gives the FDA authority to refuse entry to any seafood product where the FDA is not permitted to inspect the foreign production plant. The guidance is to say what the FDA considers to be refusal.
Some of the proposals are quite draconian, including a demand for a 24 hour response to any request for an inspection.
The FDA does not pre-announce inspections at US facilities. However, at overseas facilities, the FDA will request to schedule an inspection..
