Judge Tossed Out Injunction to Stop Observer Payments for NE Boats During Trial, Not Entire Case

On Monday February 1 we ran a story about the start of price negotiations between New England groundfish sector managers and third-party services for at-sea observer costs (New England's Groundfish Sectors Prepare to Pay At-Sea Observer Costs Starting March 1).
In our News Summary that day we stated that "a federal judge tossed out a lawsuit filed by East Coast fishermen that challenged NOAA’s mandate for fishermen to cover observer costs.”
However, that lawsuit was not dismissed, instead it was an injunction filed with the lawsuit that sought to prevent the at-sea observer costs from being levied during the time of the trial. The court ruled that the statute did not permit preliminary relief, but it did not address the merits of the case at all...
